Hoboken’s Half-Assed OPRA Response for WILLIAM D. CAMPBELL vs. CITY OF HOBOKEN!
Fifteen days after the attorneys for Appellant CAMPBELL (WILLIAM D. CAMPBELL vs. CITY OF
HOBOKEN) submitted an OPRA (Open Public Records Act) request to the City of Hoboken, the law firm finally received two response packets. The first packet, dated October 14, 2010 City OPRA LOG # 10-1696, consists of 10 pages while the second packet, dated October 15, 2010 City OPRA LOG # 10-1695, consists of 29 pages.
For the record, there is no question that the law firm faxed the OPRA request to the Hoboken City Clerk’s Office on September 29, 2010 @ 4:02pm and entered into the OPRA LOG file the following business day, September 30, 2010 @ 9:36am.
The OPRA request consisted of FIVE (5) individual information questions. I will concentrate on the shortfalls found in Questions # 1 and #2 which deal specifically with personnel issues. Questions 3, 4, and 5 address Retirement Applications, Salary Ordinance Information, and Job Descriptions.

1 Salary Ordinance “Z-47” was passed by the City Council on July 14, 2010 and approved by Mayor Zimmer on July 15, 2010. The Ordinance became effective 20 days later on August 4, 2010. Both Liston and Melli pay increases relied upon passage of “Z-47”. 2 Daniel Byran’s Salary Range $28,840 - $90,028.51 for his JOB TITLE “Confidential Aid” remained unchanged from the previous Salary Ordinance enacted 01/01/2008. His salary increase did not depend upon passage of “Z-47”.

WHO DROPPED THE BALL?
Can’t blame the City Clerk’s Office for this one! In a memo dated September 30, 2010, the City Clerk reminds “Michael Korman – Personnel” and “Corporation Council Mark Tabakin / Alysia Smickley” that information must be returned to the City Clerk’s Office within Seven days per OPRA. See MEMO
On October 14, 2010, Michael Korman – Personnel sends a memo to Corporation Counsel Tabakin advising that the requested documents are being forwarded to the Law Department for review and release. See MEMO
The timeline issues between the City receiving the OPRA request and the subsequent response to the requester may not be as critical as the apparent breakdown of quality control with respect to a non-complicated OPRA request.
